Furthermore, the Applicant did not show that the new evidence would have materially changed the court's decision. As such, the requirements for review under Rule 32(1) of the Industrial Court (Procedure Rules) 2010 were not met. The court therefore declined to review or set aside the original judgment and confirmed the award to the Claimant.
