Miscellaneous Criminal Application / Ruling on Application for Review of Sentence After Dismissal of Appeal

  1. 1 Whether the High Court has jurisdiction to review a sentence after it has already determined an appeal on the same conviction and sentence.
  2. 2 Whether the principle of functus officio applies to bar the High Court from entertaining the application for sentence review.

Ratio Decidendi

The High Court held that it lacks jurisdiction to review or alter a sentence after it has already determined an appeal on the same conviction and sentence. Once the court has fully pronounced itself on an appeal, it becomes functus officio and cannot revisit its own decision. The applicant's only available remedy is to appeal to the Court of Appeal. The application for review of sentence was therefore dismissed for want of jurisdiction and lack of merit.
