  1. 1 Whether the defendant is in rent arrears as claimed by the plaintiffs.
  2. 2 Whether the plaintiffs are entitled to vacant possession of the suit property.
  3. 3 Whether the plaintiffs are entitled to mesne profits from 1st June 2015 until vacant possession is obtained.

Ratio Decidendi

The court found that the plaintiffs had proved on a balance of probabilities that the defendant was in rent arrears and had continued to occupy the suit property after the lease was terminated. The defendant, despite being served, failed to attend the hearing or provide evidence to rebut the plaintiffs' claims. The lease agreement and demand letters established the plaintiffs' entitlement to rent arrears and mesne profits. The court held that the plaintiffs were entitled to vacant possession, payment of Kshs.1,209,500 in rent arrears, mesne profits at Kshs.6,500 per month from 1st June 2015 until possession is given, and costs of the suit.
