Procedural Posture

Civil Suit / Ruling on Contempt Application

  1. 1 Whether there was personal service of the court orders on the 1st Defendant.
  2. 2 Whether the 1st Defendant is culpable for contempt of court for disobeying court orders.
  3. 3 Whether the Plaintiffs are entitled to the remedies sought for contempt of court.

Ratio Decidendi

The court found inconsistencies in the Plaintiffs' evidence regarding personal service of the court orders on the 1st Defendant prior to 13th March 2013. The only undisputed personal service occurred on 13th March 2013. The Plaintiffs failed to provide evidence of any acts of contempt by the 1st Defendant after this date. Given the higher standard of proof required in contempt proceedings and the lack of clear evidence of post-service disobedience, the Plaintiffs did not discharge their burden. Consequently, the application for committal for contempt fails, and no relief can be granted.
