The parties did not agree on a joint valuer, and the Government Valuer (County Valuer, Kilifi, Lamu and Tana River Counties) conducted a valuation and filed a report valuing the defendant's developments at Kshs. 480,000. The alternative report by M/s Ultimate Valuers was not in compliance with the decree and could not be adopted. Therefore, the amount payable by the plaintiff to the defendant is Kshs. 480,000 as per the Government Valuer's report. The court is now functus officio and the defendant may appeal if dissatisfied.
