The plaintiff did not obtain any order varying or staying execution of this order before the expiry of the 60 days, and was therefore in unlawful possession after that date. The subsequent stay order by Justice Nyamweya did not reinstate the plaintiff's case or suspend the finality of the eviction order, as it only stayed proceedings related to execution and not the substantive order itself.
