The court found that although there was a period of inactivity in the prosecution of the suit, the plaintiff provided a plausible and satisfactory explanation for the delay, namely his son's illness and the impact of the Covid-19 pandemic, supported by documentary evidence. The court was satisfied that sufficient cause had been shown and that the interests of justice would be served by allowing the suit to proceed. The defendant did not demonstrate sufficient prejudice that would warrant dismissal.
