The applicant acted promptly upon learning of the ruling. The court was satisfied that the applicant demonstrated sufficient cause for extension of time under Section 79G of the Civil Procedure Act. On the issue of stay, the court found that there was ongoing construction on the suit property, and the character of the property could change, rendering the intended appeal nugatory. The applicant had shown the risk of substantial loss and had previously been granted an injunction before the suit was dismissed...
