Ratio Decidendi

The Tribunal found that the tenant had complied with the statutory requirements by filing the reference in time and had communicated his inability to attend the hearing due to being out of the country. The Tribunal was persuaded that the tenant should not be denied the opportunity to prosecute his reference on the merits, especially in light of the right to a fair hearing under Article 50(1) of the Constitution. Consequently, the Tribunal set aside the earlier dismissal order and reinstated the reference, allowing the tenant to enjoy quiet possession pending the hearing and directing the parties to exchange documents and fix the matter for hearing.
