Ratio Decidendi

The court found that although the Director of Occupational Safety and Health Services initially awarded the Applicant Kshs 640,127, this was revised to Kshs 120,421 following a second medical assessment. The 1st Respondent claimed to have paid part of the award, but the only evidence provided was a cheque made out to itself, not the Applicant. No credible evidence was produced to show the Applicant received any payment. The statutory period for appeal had lapsed, and the Respondent did not contest the revised award. Therefore, the court adopted the Director's revised award as its judgment, ordered payment of the sum to the Applicant, and awarded costs and interest from the date of filing.
