Ratio Decidendi

The court found that, despite the applicant's positive rehabilitation record and the probation report's recommendation, he does not meet the eligibility criteria for non-custodial sentences as set out in the Chief Justice's memo. The applicant has only served three years of a ten-year sentence for rape and therefore does not fall within the category of inmates serving three years or less, nor does he have a balance of three years or less remaining. The court held that the policy directive is clear and binding, and the applicant's circumstances do not warrant an exception. Accordingly, the application for a non-custodial sentence was declined.
