The High Court found that the Political Parties Dispute Tribunal exceeded its mandate by setting aside its own judgment of 28/4/2022 without a fair hearing, and that its subsequent orders of 14th and 19th May 2022 were improperly and irrationally issued, especially in light of the High Court's stay orders. As a result, the judgment of 28/4/2022 remained intact at the time the 2nd Respondent cleared the 3rd Respondent. The 2nd Respondent, being aware of the subsisting judgment, acted irrationally in clearing the 3rd Respondent for nomination.
