Ratio Decidendi

The High Court lacks jurisdiction to review its own decision on sentence after an appeal has been determined and dismissed. The applicant has not demonstrated any of the exceptional circumstances required for review, such as fraud, nullity, or mistake. The Supreme Court's decision in Muruatetu does not apply to sentences under the Sexual Offences Act or to minimum sentences generally, but is confined to the mandatory death sentence for murder under Section 204 of the Penal Code. The applicant's reliance on Muruatetu and related authorities is therefore misplaced. The application for review of sentence is without merit and must be dismissed for want of jurisdiction.
