No defenses or affidavits had been filed to introduce or prove the existence and legality of the charge, nor to counter the Plaintiff's claim of rescission of the sale agreement and retention of ownership. The preliminary objection was therefore premature and did not meet the threshold set out in Mukisa Biscuit, as it was not based on undisputed facts or a pure point of law...
