The High Court found that the Resident Magistrate, Hon. B.J. Bartoo, acted in excess of her pecuniary jurisdiction by issuing ex parte injunctive orders in a matter where the value in dispute was Kshs. 15,728,207, far above the statutory limit of Kshs. 5,000,000 for a Resident Magistrate. The court held that jurisdiction is foundational and any orders issued without it are null and void ab initio. The court further determined that the impugned orders were not spent, as their effect continued through subsequent status quo orders.
