Procedural Posture

Miscellaneous Application / Ruling on Application for Review of Eviction Order

  1. 1 Whether the court should review the eviction order issued on 10th November, 2023 to direct enforcement to the Officer Commanding Station Melelo Police Station instead of Olulunga Police Station.
  2. 2 Whether the application for review was properly before the court or should have been placed before the Deputy Registrar who issued the original order.

Ratio Decidendi

The court found that the application sought review of an order issued by the Deputy Registrar on 10th November, 2023. Under the Civil Procedure Act and Rules, review of an order must be sought before the same judicial officer who issued it. Since the present application was not placed before the Deputy Registrar, but before the judge, the court lacked jurisdiction to entertain the application for review. The proper procedure was not followed, and therefore the application was struck out. The court did not address the substantive merits of the request to change the enforcement authority for the eviction order, as the threshold procedural requirement was not met.

Court Disposition

Application struck out for want of jurisdiction; no order as to costs.

Orders
