Legal Issues
- 1 Whether the applicant has demonstrated sufficient urgency to warrant a stay of execution of the judgment in Kisumu SCCC No. E235/2023.
- 2 Whether the execution process has commenced to justify the grant of stay orders.
Ratio Decidendi
The court found that execution had not commenced and that no urgency had been demonstrated by the applicant. However, in the interests of justice and to preserve the subject matter, the court granted a limited stay of execution for 7 days to allow service of the application and filing of a response. The court emphasized that interim relief is only justified where urgency is clearly established, and that the applicant had not met this threshold. The orders were made to ensure procedural fairness and to allow the respondent an opportunity to be heard before further directions are given.
