The court granted a stay of execution of the judgment on the condition that the Applicants pay one-third of the decretal sum to the Plaintiff within 60 days and furnish security for the remainder from a reputable financial institution within the same period. The Applicants' arguments regarding financial hardship due to Covid-19 were disregarded as they were not supported by affidavit evidence. The court found the proposed security of Kshs.500,000 unreasonable in light of the total decretal sum of Kshs.8,757,815 and rejected the claim that Kshs.1,000,000 had been paid as part payment.
