The Tribunal found that the Landlords, as beneficiaries of the estate, are entitled to the rents and profits of the premises and thus qualify as landlords under Cap 301, even without Letters of Administration. The Tribunal held that the death of the landlord does not relieve the tenant from paying rent, and the Landlords are empowered to issue a notice of termination. However, due to lack of documentary evidence from either party regarding payment or arrears, the Tribunal could not conclusively determine the existence or quantum of rent arrears.
