Ratio Decidendi

The court found that the applicants complied with the condition for stay of execution by depositing half the decretal sum as ordered. The respondent's execution for the remaining half was based on a misinterpretation of the court's order, as there was no direction for payment of the remaining half to the respondent. Although the respondent may not have been notified of the deposit, it was incumbent upon his advocate to confirm compliance before instructing auctioneers. The warrants of attachment and proclamation notice were therefore irregular and set aside. The auctioneer's fee is to be shared equally between the parties. The certificate of costs cannot be set aside in this application;...
