Ratio Decidendi

The court found that while it was prepared to excuse the applicant's lapses and delays prior to 11th December 2012, there was no credible or sufficient explanation for the subsequent five-month delay before filing the present application. The applicant failed to satisfy the statutory requirement of demonstrating good and sufficient cause for the entire period of delay as required under Section 79G of the Civil Procedure Act. Consequently, the court dismissed the application for leave to appeal out of time.
