The court held that it should not arbitrarily interfere with proceedings before the magistrates' courts except on appeal or in matters of transfer of suit. The applicant had not demonstrated that he had sought and been denied a stay of proceedings in the Chief Magistrate's Court. The proper procedure requires that an order of stay of proceedings must first be sought in the trial court unless it is being sought pending appeal or as a substantive prayer on appeal. Since the applicant had not availed the trial court the opportunity to consider the application for stay, there was no good ground for approaching the superior court.
