Ratio Decidendi

The appellate court found that the trial court erred in dismissing the appellant's claim for special damages relating to the motor vehicle. The court held that the appellant was only required to prove the extent of the damage and the cost to restore the vehicle, not that the repairs were actually carried out or paid for. The assessor's report provided sufficient evidence of the loss. Since repairing the vehicle was uneconomical, the correct measure of damages was the pre-accident value less the salvage value. The court substituted the trial court's decision with an award of Kshs 250,000, representing the loss occasioned to the appellant by the respondent's tortious conduct.
