Ratio Decidendi

The court lacks jurisdiction to entertain an appeal where the Appeals Committee has not rendered a decision. Section 8 of the Land Disputes Tribunals Act provides that appeals to the High Court (now Environment and Land Court) can only be made from decisions of the Appeals Committee. Since the Embu Provincial Appeals Committee never finalized or delivered a decision in this matter, there is no valid appeal before the court. Entertaining such an appeal would be tantamount to acting without jurisdiction, which is impermissible. The court must down its tools immediately upon realizing it lacks jurisdiction, and any proceedings founded on a non-existent decision are a nullity.
