The application for injunction was therefore competent. On the merits, the court found that the issue of the tribunal's jurisdiction was significant, as the dispute might involve more than a simple boundary issue and could amount to an excision of a substantial portion of land. Given these circumstances, the court granted an injunction restraining the respondent from interfering with the appellant’s land pending the determination of the appeal.
