Ratio Decidendi

The court found that the subdivision of parcel Kericho/Kipchichim/238 and the issuance of new titles were not authorized by any court order and were contrary to the amended certificate of confirmation of grant dated 12th April 2016. The Land Registrar's actions, taken at the behest of the respondents, were therefore unlawful. The court held that the estate property must be distributed strictly in accordance with the confirmed grant, which required subdivision into five specific shares. As a result, the court declared the subdivision and resultant titles null and void, ordered cancellation of the new titles, and directed that the land revert to its original title for proper redistribution.
