The court found that the application for stay of execution was made without unreasonable delay and that the applicant had demonstrated a risk of substantial loss if the decretal sum was paid out and the appeal subsequently succeeded, as the respondent might not be able to refund the amount. However, since the appeal was only on the quantum of damages, the court held that a stay of execution was justified only if the applicant paid part of the decretal amount to the respondent as security. The court considered the offer of a bank guarantee but determined that part payment of Kshs.200,000 to the respondent would serve as adequate security.
