The High Court found that while the appellant pleaded the full amount of special damages, only those amounts supported by actual receipts could be awarded. The trial court erred by omitting Kshs. 12,050 in special damages that were proved by receipts, but correctly excluded Kshs. 615,627, which was not supported by a receipt. The court also held that interest on special damages should run from the date of filing suit, not from judgment, in line with statutory and case law. The appeal was allowed to the extent of correcting the special damages award and the date from which interest on special damages should accrue.
