The court found that the trial court failed to consider the period the petitioner spent in pre-trial custody, as mandated by Section 333(2) of the Criminal Procedure Code and reinforced by the Judiciary Sentencing Policy Guidelines and appellate authority. The petitioner was in custody from 27th October 2021 until sentencing on 4th May 2023, amounting to 1 year and 7 months. The failure to deduct this period from the 8-year sentence constituted an error. The court therefore ordered that the aggregate period of 1 year and 7 months be factored into the sentence, reducing the effective custodial term accordingly.
