In this case, the land in question had already been transferred to a third party, Patrick Shitakha Ogaba, who was not a party to the suit and against whom no impropriety was alleged. The transfer was for value and there was no evidence that the third party was not a bona fide purchaser. The ex parte judgment was entered seventeen years prior, and the subject matter had since changed hands.
