Ratio Decidendi

The trial magistrate who took over the proceedings from his predecessor failed to comply with the mandatory requirements of Section 200(3) of the Criminal Procedure Code by not informing the appellants of their right to have previous witnesses re-summoned and re-heard. This omission is a fatal procedural error that renders the entire trial null and void. The appellate court, therefore, quashed the conviction and set aside the sentence. Considering the interests of justice and the nature of the evidence, the court ordered a re-trial before a different magistrate with competent jurisdiction, excluding the previous trial magistrates.
