The evidence of underpayment was uncontroverted, and the claimant was entitled to recover the difference between statutory minimum wages and actual pay for the relevant periods. The deduction of Kshs.200 was not justified and was refundable. However, the claimant was not entitled to service pay as he was a member of NSSF. The court awarded underpayments, compensation for unfair termination (four months' salary), and refund of the wrongful deduction, totaling Kshs.115,210.80.
