Ratio Decidendi

The High Court found that although the sentence of 5 years imprisonment for handling stolen goods was within the legal maximum, it was harsh given the circumstances: the value and nature of the items, the fact that the appellant was arrested almost immediately after the incident, and that all items except Kshs.500/= were recovered. The appellant had also been in custody since 2009, and the period already served was deemed sufficient punishment. The court exercised its discretion to interfere with the sentence, setting it aside and substituting it with the period already served, thereby ordering the appellant's immediate release unless otherwise lawfully held.
