Ratio Decidendi

The court found that the deposit of Kshs. 300,000 was made as security for the judgment in the present case, which still stands in favour of the plaintiff. The dismissal of the declaratory suit did not affect the status of the judgment or the purpose of the deposit. Since the judgment has not been set aside, there is no basis for releasing the deposit to the defendant's advocates. The application for release of the deposit is therefore premature and without merit. The proper course for the defendant would be to apply for setting aside the judgment before seeking release of the deposit.
