The court held that the Land Disputes Tribunal lacked jurisdiction to determine issues of title to registered land under section 3(1) of the Land Disputes Tribunals Act and section 159 of the Registered Land Act. The Tribunal's award, which purported to determine ownership and title to KIGANJO/MUNDORO/1212, was therefore null and void.
