Ratio Decidendi

The court found that the Gachagi group had been in occupation of the suit land long before the 1st defendant's registration as proprietor in 1991. Although the land was public prior to 1991 and thus not subject to adverse possession, the leasehold interest granted to the 1st defendant in 1991 marked the point from which time could run. The plaintiffs' occupation was open, continuous, and exclusive, and by 2003 (12 years after registration), they had acquired prescriptive rights. The 1st defendant's subsequent suit for eviction in 2005 did not interrupt the period.
