The Court of Appeal held that the appellant failed to comply with the mandatory procedural steps set out in Paragraph 11 of the Advocates Remuneration Order. Specifically, the appellant did not file a notice of objection to the Deputy Registrar's taxation, did not obtain reasons for the decision, and did not make a reference to a High Court judge. Without a determination by a High Court judge and leave to appeal, the appellate jurisdiction of the Court of Appeal could not be properly invoked. Furthermore, the notice of appeal was filed out of time and was defective. As a result, the appeal was found to be premature and procedurally incompetent, warranting dismissal with costs.
