Ratio Decidendi

The High Court found that the respondent failed to prove, on a balance of probabilities, that she sustained a dislocated shoulder joint, as no x-ray evidence or report was produced despite being available. The only proven injuries were soft tissue injuries to the knee, back, chest, neck, forehead, and tenderness on the right shoulder. The trial court's award of Kshs. 300,000 was based on the unproven dislocation and was therefore excessive. Considering comparable awards for soft tissue injuries and the issue of inflation, the High Court set aside the award of Kshs. 300,000 and substituted it with Kshs. 200,000 in general damages. Each party was ordered to bear their own costs of the appeal.
