The court held that an advocate cannot exercise a lien over client funds on the basis of a bill of costs that has not been taxed. The advocate's fees only become due after taxation, and until then, the entire amount belongs to the client. The court found that the advocate's failure to comply with previous court orders to deposit the funds in court was unjustified and that her fears regarding non-payment of fees were not a legal basis to withhold the client's money. The advocate's delay in taxing her bill of costs was attributed to her own indolence, and equity does not favour such conduct.
