Ratio Decidendi

The court found that while the application for stay was filed without unreasonable delay, the appellant failed to demonstrate the substantial loss he would suffer if the order for stay was denied. The mere possibility of execution and attachment of property does not amount to substantial loss, as execution is a lawful process. Since the cornerstone requirement of substantial loss was not met, the court found no basis to consider the provision for security for due performance. Consequently, the application for stay of execution pending appeal was dismissed with costs to the 1st respondent.
