The court found that although there had been delay by the plaintiff in prosecuting the suit, the defendant's counterclaim was so intertwined with the plaintiff's claim that dismissing the main suit would preclude proper adjudication of the counterclaim. The court also noted that the case had already been certified as ready for trial, making it possible to proceed without further delay. The interests of justice, therefore, dictated that the plaintiff's claim be sustained to allow both the claim and counterclaim to be determined on their merits. The application for dismissal was thus dismissed, with costs to be in the cause, as the preservation of the suit served the interests of both parties.
