Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant has satisfied the conditions for grant of stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules, 2010.
  2. 2 Whether the applicant is required to provide security for the due performance of the decree.
  3. 3 Whether the delay in filing the application was unreasonable.

Ratio Decidendi

The court found that the applicant had demonstrated a likelihood of substantial loss if the stay was not granted, as he risked eviction from his only place of abode. The application was filed within a reasonable time after the judgment, and the applicant was not exempt from providing security for due performance of the decree. The court exercised its discretion to grant a stay of execution, subject to the applicant depositing KES 50,000 or equivalent security within 30 days. The court was guided by the principles set out in Order 42 Rule 6 of the Civil Procedure Rules, relevant case law, and the need to preserve the appeal from being rendered nugatory.

Court Disposition

Application for stay of execution pending appeal granted, subject to deposit of security.

Orders
