Ratio Decidendi

The High Court found that the evidence did not support the particulars of either count of giving false information. The appellant's report to the police did not allege force or robbery as stated in the particulars, and there was no evidence that false information was given to the officer named in count II. The trial magistrate misdirected herself by convicting on charges not supported by the evidence and by imposing a compensation order for reputational harm, which is not contemplated under Section 31 of the Penal Code. The conviction was therefore quashed and the sentence, including the compensation order, set aside.
