It found that the award of Kshs 2,000,000 as general damages for pain, suffering, and loss of amenities was within the range of comparable cases involving amputation and multiple fractures, and thus not excessive. The court held that the award for loss of earnings was erroneous because, although pleaded, it was not proved by evidence of actual earnings prior to the accident, and therefore struck it out.
