The court held that while the use of a memorandum of appeal instead of a chamber summons is a procedural irregularity that does not go to the root of the court's jurisdiction and is curable under Article 159(2)(d) of the Constitution, the failure to file the appeal within the mandatory 7-day period stipulated by rule 55(5) of the Auctioneers Rules is a substantive defect. The court found that the appeal was filed 13 days after the impugned decision, outside the statutory period, and no application for extension of time or leave to admit the appeal out of time was made.
