Ratio Decidendi

The court found that, although manslaughter is a grave offence with a maximum penalty of life imprisonment, the accused persons were first offenders, had spent approximately eight years in custody, and demonstrated genuine remorse. The pre-sentence reports, as well as the views of the victim's family and community, supported a non-custodial sentence. The court determined that a custodial sentence would not serve the objectives of sentencing, including rehabilitation and community reintegration, and therefore exercised its discretion to impose a probation order rather than imprisonment.
