The court found that the Certificate of Confirmation of Grant was issued in error, as it failed to reflect the terms of the Mediation Settlement Agreement that had been adopted by the parties and sanctioned by the court. The court held that a mediation settlement, once adopted by the court, is binding and can only be set aside on grounds sufficient to vitiate a contract. The failure to issue the certificate in accordance with the mediation agreement constituted an error apparent on the face of the record, justifying review.
