The court found that the Plaintiffs' replying affidavit was defective as it was not sworn by any deponent, contrary to the requirements of the Civil Procedure Rules, and therefore struck it out. On the substantive application, the court applied the established principles for granting interlocutory injunctions, noting that the Plaintiffs were in occupation of the suit property and had undertaken activities thereon. The court determined that it was necessary to preserve the suit property pending the hearing and determination of the suit.
