Procedural Posture

Environment and Land Court Ruling on Notice of Motion / Application to Set Aside Dismissal and Reinstate Suit After Substitution

  1. 1 Whether the court should set aside the dismissal orders made on 25.9.2023 and reinstate the suit.
  2. 2 Whether leave should be granted to file a reply to defence and defence to the 4th defendant’s amended defence and counter-claim.
  3. 3 Whether the suit had already abated by operation of law due to failure to substitute the deceased plaintiff within one year.

Ratio Decidendi

The plaintiff died on 5.4.2023 and no application for substitution was made within one year, so the suit abated by operation of law. Because the applicants filed a motion seeking only to set aside dismissal and reinstate the suit, without a proper application for extension of time or revival of an already abated suit, the motion was incompetent and had no legal foundation. The earlier substitution order was therefore a nullity, and the motion was dismissed.

Court Disposition

Notice of Motion dated 18.11.2025 dismissed with costs to the 4th Defendant.

Orders

  • The application to set aside the dismissal order and reinstate the suit was rejected.
  • The request for leave to file a reply to defence and defence to counter-claim was rejected.
