Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time and Stay of Execution

  1. 1 Whether the applicant should be granted leave to appeal out of time against the decision of the Tax Appeals Tribunal.
  2. 2 Whether a stay of execution should be granted pending the hearing and determination of the intended appeal.

Ratio Decidendi

The court found that the applicant provided a reasonable and satisfactory explanation for the delay in filing the appeal, namely the fallout with its previous advocate and the late receipt of necessary documents. The delay, being slightly over 30 days, was not inordinate. The court exercised its discretion to grant leave to appeal out of time. Regarding the stay of execution, the court noted that the applicant had not demonstrated substantial loss or offered security, but nonetheless granted a conditional stay on the basis that the applicant pays Kshs. 4 million to the respondent within 30 days as security. The orders sought were therefore allowed, balancing the interests of both parties.
